Biography

Hannah Meijer has been a lecturer in Constitutional and Administrative Law in the Faculty of Law at the University of Aruba since 2023. Hannah's research interests lie in comparative constitutional law. Her current research focuses specifically on Kingdom affairs and the (constitutional) position of the different countries and municipalities within the Kingdom of the Netherlands when they want to collaborate on performing public tasks. The research has a strong focus on democratic legitimacy of such collaborations and the competences representatives/parliament members have to oversee those within the Kingdom.

De 'status aparte' van de Arubaanse bezwaaradviescommissie: oplossing of probleem?

In de bijdrage wordt onderzocht hoe en waarom de betrekking van een adviescommissie op de verschillende Caribische eilanden verschilt in de bestuursrechtelijke bezwaarprocedures. De Arubaanse commissie heeft een duidelijke 'status aparte', en wij concluderen dat recente jurisprudentie duidelijk maakt dat het huidige systeem niet zonder meer gehandhaafd kan blijven omdat de rechter een verantwoordelijkheid bij de Arubaanse bestuursorganen neerlegt waarvoor geen duidelijk wettelijk kader bestaat en waarvoor zij mogelijk operationeel niet zijn uitgerust.

De werking van dualistische spelregels in de Caribische landen

Dit artikel behandelt twee recente Arubaanse en Curaçaose voorvallen die te maken hebben met de vertrouwensrelaties tussen parlement en regering. De voorvallen worden in een breder perspectief van het parlementair systeem geplaatst. Er wordt ingegaan op de vertrouwensregel en het ontbindingsrecht, de invloed van politieke partijen en het vrij mandaat en de rol van de Statenvoorzitter. De auteurs concluderen dat zowel in Aruba als Curaçao blijkt dat de dualistische spelregels in het parlementair systeem niet optimaal functioneren.
